1. Acceptance of Terms

By downloading, installing, or using Evolvin ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Evolvin is a personal growth and self-reflection application that uses artificial intelligence to provide coaching conversations, guided reflection sessions, journaling tools, and a personal Shadow Web — a visual map of your inner patterns, beliefs, and values.

3. Important Disclaimers

3.1 Not Medical or Therapeutic Advice

Evolvin is not a substitute for professional mental health care, therapy, counseling, or medical advice. The App is designed as a personal wellness and self-reflection tool only. If you are experiencing a mental health crisis, please contact a qualified mental health professional or emergency services immediately.

3.2 AI-Generated Content

The App uses artificial intelligence to generate responses, insights, and suggestions. AI-generated content may be inaccurate, incomplete, or inappropriate. You should not rely solely on AI responses for important life decisions. All AI interactions are generated algorithmically and do not represent the views or advice of qualified professionals.

3.3 No Guarantee of Outcomes

We do not guarantee any specific results, improvements, or outcomes from using the App. Individual experiences will vary.

4. Eligibility

You must be at least 13 years of age to use Evolvin. By using the App, you represent that you meet this minimum age requirement. If you are under 18, you should have consent from a parent or guardian.

5. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate information when creating your account.
  • You may delete your account at any time through the App's settings.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to abuse, overload, or interfere with the App's AI services
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use automated tools or bots to interact with the App
  • Impersonate another person or create false accounts

We enforce rate limits on AI interactions to ensure fair usage for all users.

7. Subscriptions & Payments

  • Evolvin offers both free and premium subscription tiers.
  • Subscriptions are processed and managed through the Apple App Store or Google Play Store.
  • Payment terms, renewal, and cancellation are governed by the respective app store's policies.
  • You can manage or cancel your subscription through your app store's subscription settings at any time.

8. Intellectual Property

  • You retain ownership of the content you create in the App (journal entries, chat messages, goals, etc.).
  • By using the App, you grant us a limited license to process your content solely for the purpose of providing the service (e.g., sending messages to AI for responses, storing data for sync).
  • The App itself, including its design, code, and branding, is owned by Evolvin and protected by intellectual property laws.

9. Account Suspension & Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in abusive behavior. In such cases, we will make reasonable efforts to notify you. You may delete your account at any time. Upon deletion, your data will be permanently removed after a 30-day grace period as described in our Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by law, Evolvin is provided "as is" and "as available" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to emotional distress, reliance on AI-generated content, or loss of data.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the App or other means. Your continued use of the App after changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.
